Terms of Service

These Terms of Service (“Terms”) govern your use of Convo, operated by Crema at convosurvey.ai. By accessing or using Convo, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. The Service

Convo is an AI-powered interview and qualitative data collection platform. It allows registered admins to create interview templates, generate shareable links, and collect conversational responses from participants. AI-generated summaries and extractions are provided as a convenience and should be reviewed for accuracy.

2. Accounts

To create and manage interviews, you must register for an account using either an email address and password or your Google account via Google OAuth. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at george@crema.us if you suspect unauthorized access.

You must provide accurate information when registering. Account access is invite-only; we reserve the right to approve or deny account creation. Accounts may not be shared or transferred without our written consent. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to use Convo to:

  • Collect data from individuals without their knowledge or consent
  • Conduct interviews that are deceptive, harassing, or harmful
  • Violate any applicable laws or regulations, including privacy laws
  • Collect sensitive personal data (health, financial, or government ID data) without appropriate safeguards
  • Attempt to reverse-engineer, scrape, or disrupt the service
  • Impersonate any person or organization
  • Use the service to send unsolicited communications

4. Content

You retain ownership of interview questions, templates, and respondent data you collect through Convo. By using the service, you grant Convo a limited license to process and store this content solely to operate and improve the service.

You are solely responsible for ensuring that your use of Convo — including the questions you ask, the audiences you target, and the data you collect — complies with applicable laws.

5. AI-Generated Content

Convo uses AI (Anthropic Claude) to conduct conversations and generate summaries. AI-generated content may contain errors, omissions, or inaccuracies. You are responsible for reviewing AI outputs and should not rely on them as a substitute for professional advice. We make no warranty regarding the accuracy or completeness of AI-generated summaries.

6. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for obtaining appropriate consent from interview participants before collecting their data.

7. Availability and Changes

We strive to maintain high availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the service with or without notice. We are not liable for any interruptions or changes to the service.

We may update these Terms from time to time. We will notify you of material changes. Continued use after changes are posted constitutes acceptance.

8. Termination

You may stop using Convo at any time. We may suspend or terminate your access if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the service ceases. You may request deletion of your data as described in our Privacy Policy.

9. Disclaimer of Warranties

Convo is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be error-free, secure, or uninterrupted.

10. Limitation of Liability

To the fullest extent permitted by law, Crema and its affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Convo, including loss of data, profits, or business opportunities, even if advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or your use of the service will not exceed the greater of $100 or the amounts you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Crema, its affiliates, and their respective officers, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorney’s fees) arising from your use of the service, your content, or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Missouri, United States, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Missouri.
